Qualifying for Canadian Agricultural Stream (CAS) – Employers

In order to qualify for the Canadian Agricultural Stream, the employer must meet the following conditions:

  • The production must be in specific commodity sectors, such as fruits, flowers, vegetables, tobacco, and apiary products.

  • The job activity must be related to on-farm primary agriculture, such as operating agricultural machinery, breeding animals, and harvesting crops.

Employers who meet the above eligibility requirements may be able to hire temporary foreign workers through the Canadian Agricultural Stream.

Eligibility Criteria for CAS in British Columbia – Employees

Only eligible temporary foreign workers can be employed through the Canadian Agricultural Stream program. Hence, in order to qualify for the Temporary Foreign Worker Program (TFWP) in Canada, you must:

  • Have a valid employment offer from a Canadian employer.

  • Prove that you will leave Canada once your work permit expires.

  • At least 1 or 2 years of work experience in a relevant field (agriculture).

  • Respect the conditions of your work permit

  • Be in good health.

  • Show proof of sufficient funds to finance your stay in the country.

  • Have a clean criminal record

  • Prove that you’re not a national security threat.

  • Prove that you won’t work for an employer offering erotic massage, striptease, escort, or erotic dance services.

The temporary foreign employee can be from any country, and the duration of the Labour Market Impact Assessment (LMIA) is for two (2) years. An experienced lawyer can determine whether you’re eligible for the Temporary Foreign Worker Program and help submit your application and other supporting documentation.

How to Apply for a Work Permit

Here are the steps to apply for a temporary work permit:

  • Obtain a copy of the Labour Market Impact Assessment (LMIA).

  • Submit your work permit application to the IRCC.

  • The IRCC will review your documents, verify your application, and make a decision.

  • If you meet the necessary requirements and your application is approved, a work permit will be issued to you.

The work permit will allow you to work for the Agricultural Stream employer based on the terms of your employment. Generally, a work permit for a temporary foreign worker employed through the Canadian Agricultural Stream program will be valid for a maximum of two years. A Canadian Agricultural Stream lawyer can help submit your work permit application and increase your chances of approval.
